Do War Crimes really exist?

The notion of 'war crimes' first really came into the mainstream in the closing days and aftermath of World War 2. Prior to that, international laws of war were constructed around the turn of the century, but several nations (such as Japan) never signed such treaties and did not do so until forced after World War 2.

So do 'war crimes' exist? Is any killing of a civilian a war crime, or is it only in certain circumstances? Was the firebombing of Dresden a war crime? Was the A-bomb a war crime?

As a follow up, can 'war crimes' really exist if it is only a crime the losers get punished for? Can a nation that participated in 'war crimes' itself morally try and convict a citizen of an enemy nation for such crimes?

Yes there is such thing as crossing the line even during war. google unit 731 and japanese atrocities. I'd much rather be captured by Germans or Russians than the Japanese.

actually, assuming you aren't a Jew, in WW2 you would much rather be captured the Germans than either the Russians or the Japs.

In the military you can technically be charged with a war crime for any violation of the Geneva Convention. The most basic way it was explained to us was, you can "double tap" someone in front of you...but if they are not dead and you turn around and shoot again, it's a violation.

Dropping not just 1 but 2! atomic bombs on the innocent civilians of Japan was the biggest war crime ever committed. But we won the war so we just pretend it wasn't a big deal. 'Merica.

Dropping one bomb to drive home the point it was ridiculous to continue the war was the goal. However, the Japs refused to surrender & in fact kept on fighting in some areas, so the second bomb was dropped to both end the war and save hundreds of thousands of American lives had an invasion been necessary. Blame the Jap military for the deaths of any innocent civilians. I know my 2 uncles, both serving in the European theater but scheduled to be a part of the invasion force were damn glad the bombs were dropped. You are speaking from the safety of you computer chair at home, almost 70 yrs post war & far removed from the realities of that time period. President Truman did what he felt best to save American lives & end the suffering of millions of people all around the Pacific theater.

Remember the technology of the time did not allow for the concept of colateral damage. The US carpet bombed tokyo and Dresden with fire bombs and did just almost as much damage as the nukes.

The same could be said about the blitz in London, Pearl Harbor, or any number of incidents.

Not Pearl Harbor. Pear Harbor was attacking 100% military targets. Yea some civilians could have been killed nearby but the goal was not to terrorize the innocent people but to attack the military of the government that was using an oil embargo against them.

Had the U.S. lost the war, the use of atomic warefare to strike a 100% civilian target would have been the worse war crime ever to occur in modern history, vastly surpassing the Nazi concentration camps. Its funny even today that we try to limit other countries from gaining weapons of mass destruction because we consider them unstable or not responsible to have them. When it is proven there is only 1 country who is irresponsible enough to use such a massive weapon that can only be used to attack civilizations, not armies.
