Incorporation doesn't confer all the benefits of marriage. Gay people have been trying for decades to find ways to get all the benefits that straight married couples get, and there's just no way to do it. No legal document anywhere can give an unmarried gay person the right to sue for the wrongful death of his or her partner, exempt them from inheritance taxes, entitle them to collect on each other's social security or government retirement benefits, nor many of the other thousands of benefits conferred by federal and state law on married spouses only. There is an entire body of law that is specifically intended to benefit married couples and exclude all others. To say there's no benefit in getting married is ridiculous. To deny a certain segment of the population the possibility of enjoying these benefits is equally ridiculous.

OK, what legal document can a gay couple draw up that entitles one to sue for the wrongful death of the other?
And even if there were such a document, what is the rationale for requiring gay people to jump through all kinds of legal hoops for every single benefit while straight couples can simply get married and have it all done automatically?
