quote:

CLEMSON — More than two years after being accused of vandalizing Howard’s Rock, Micah Rogers will have his day in court.

Rogers’ trial is scheduled to begin July 20 in Pickens County, on charges of grand larceny and malicious injury to property. Rogers, then 18, was arrested June 28, 2013 for breaking off a fist-sized piece of Clemson’s 49-year-old artifact residing within Memorial Stadium the night of June 2, 2013.

“This case has gone on a little bit longer than I certainly would have liked,” Thirteenth Circuit Solicitor Walt Wilkins told The Post and Courier last summer, “but it’s the unique nature of the case that has required us to complete our investigation so we can present and advocate a trial.”

Unless they have a confession or witness that will testify against him, he's not going to get convicted.

They have no video that can conclusively identify him.
They have no rock (recovered from the theft.)
They have no tools that can trace evidence to a connection of him and the rock.

No body, no weapon, no witness = no conviction.

They are going to try to build a circumstantial case against him, just b/c his truck was video'd in the general area in their pathetic downtown around the time of the theft. HOWEVER, on the video of the truck at the scene (that showed the guys getting out of it and hoping the fence) you couldn't make out the truck model or the guys getting out of it.

Unless someone started talking, they have nothing to really go on, and this is all for show. They've probably been delaying this hoping that one of the suspects/witnesses would crack and give up more info, and that has either happened, or the kid's lawyer is putting on pressure to expedite the trial.

Sounds like the dad and his friend got caught trying to bribe or threaten the others that were with Micah

There was hardly anything grand about the item in question.

honest question - how much time did CU spend investigating the death of Tucker Hipps compared to finding out who broke their rock?

edit - nevermind. I just researched. simply remarkable how that school operates at times.

Jurors selected

quote:

Five men and seven women were picked as jurors. As many as 38 witnesses are expected to testify during the trial.

Investigators believe that Rogers chipped off a piece of the stone on June 2, 2013.

He was arrested one month later.

If convicted, Rogers could face up to 20 years in prison.

Barber asked more than a hundred potential jurors if they were affiliated or employed by Clemson University, or related to anyone who was. He also asked who had posed at or touched Howard's Rock previously. The judge asked if anyone's support for Clemson University or a rival team would impact their ability to be unbiased during the trial.

Many said they could remain unbiased when asked questions related to the rock or to the university. Three potential jurors were dismissed because of their employment or a family member's employment with Clemson.

The judge said he expects the trial to take about a week.

I'm sure the god fearing folks up there would never slander another human being, unless of course they are part of the heathen/devil worshiping gamecock nation.

This keeps getting better and better

https://www.independentmail.com/news/attorneys-argue-value-of-howards-rock-as-trial-begins_02973216

Eppes said the rock, a piece of quartz that originated in Death Valley, California, but also common throughout Pickens County, was worth less than $2,000.

quote:

“It’s a rock as common as dirt,” he said. Most of the rock remains at the football stadium, now under significant security....

Eppes said people have continued to take pictures at the rock, players have continued to touch it as they enter the stadium and the university never insured it and does not plan on doing so now.

“What true Clemson fan would buy this, a stolen piece of Howard’s Rock,” Eppes said. “I haven’t heard from anyone who says they won’t take a picture with the rock missing a chunk.”

INTERESTING SIDE NOTES:
So Judge Barber for this case is a Gamecock
The Solicitor Cleveland is a Gamecock
The Defense Lawyer Epps is a Gamecock
and the suspect is a clemson fan....

the Taters are going to be furious.

quote:

“The idea that it has any value as memorabilia is so speculative as to be insane,” Frank Eppes told the judge in the case against Micah Rogers during a pretrial hearing at the Pickens County Courthouse on Monday.

“No true Clemson fan is going to spend money to buy this and keep it for themselves.”

quote:

A fingerprints expert from the Anderson County Sheriff's Office testified that none of the three prints taken from the Howard's Rock case and pedestal matched those of the man charged with damaging it.

quote:

Outside the presence of the jury, Eppes also asked the judge to bar testimony by an expert witness who would testify that a “faint glimmer” of light seen on a video from a surveillance camera at the stadium was Rogers climbing the fence into the area where the Rock is kept.

“I don’t think there’s any way anyone can say it’s anything,” he said.

The judge viewed the grainy 11-minute video and agreed that it was too unclear for anyone to make a definitive argument that it was someone going over the fence,

quote:

Eppes argued that his case was hurt by the university allowing the other 23 hours during the window of time in which the rock was damaged to be erased.

Oh shite, Micah fricked.

That tater will get what he deserved then.

https://www.wyff4.com/news/suspect-in-howards-rock-vandalism-headed-to-court/34243000

quote:

On Wednesday, Xavia Wynn testified that he was with Rogers and A.J. Gainey the night of the vandalism.

Wynn told jurors that Rogers "scurried up" the wall and went over the fence into Memorial Stadium, where Howard's Rock is located.

Wynn said that he then heard glass breaking and the sound of hammering.

Several minutes later, Wynn said Rogers did a dance in the street and said, "I got what I want. I got a piece of the rock."

Wynn testified that he never saw Rogers with any tools and never saw him with the rock.

State Law Enforcement Division Agent Michael Sloan also testified Wednesday.

Sloan said Rogers asked to meet with investigators after seeing his truck on a crime alert poster, which was sent out to the media.

Sloan and other investigators met with Rogers and his attorney, Frank Eppes. Gainey and Wynn also came with their attorneys.

Closing arguments will begin Thursday morning in the trial for Micah Rogers, who is accused of chipping off and stealing a piece of Clemson University’s iconic Howard’s Rock in 2013.

Rogers is charged with grand larceny and malicious injury to property. He faces up to 10 years in prison on each charge if found guilty.

Had Wynn not testified and said what he said, Rogers would've been found not guilty, but I think he's going to be convicted now. Now he gets to wear orange everyday.

Micah Rogers, a clemson fan, was found...

guilty of malicious injury, $2,000 or less and not guilty of grand larceny in the Howard's Rock trial.

The jury basically decided that the rock wasn't worth more than $2000. lol

quote:

A jury found a North Carolina man guilty of damaging Clemson University's iconic Howard's Rock.

The jury deliberated more than four hours before finding Micah Rogers, 20, guilty of malicious damage less than $2,000.

Rogers received a 30-day sentence, suspended to 25 days of community service. He also was ordered to pay $1,000 in restitution, suspended to $750 and court costs.

The verdict came after a three-day trial.

So he'll pay $750 to the court.

How much money did this cost the state and local governments?!?! All the law enforcement hours/resources, all the legal/solicitor hours, special witnesses, special investigators, just all the resources that went into this investigation/trial? Is $1 million a reasonable prediction? This was dragged on for 2 years.
