I would hope that someone in the USPTO will recognize how ridiculous this is. If "Johnny Football does not identify a particular living individual", there'd be absolutely no reason to fight that trademark!

I'd like to think the examiner will be smart enough to go "lol no" and reject that, but nobody ever went broke underestimating the USPTO. But if it does get published his lawyers will oppose and invalidate it faster than he can run a 40.
