His drinking and thereafter driving (and driving 150+ mph) was premeditated. Killing someone in the process wasn't.

doing something unlawful and someone dying in the process doesn't make it a premediated murder. Committing a felony and someone dying would fit the legal definition for felony murder, but driving excessive fast and recklessly isn't a felony.

He was charged with DUI resulting in death and reckless driving for a reason. The reason is the state wants to convict him. They don't charge people with crimes that can't result in a conviction. What he did would not fit the legal definition, nor could the state carry their burden to meet the elements for murder 1 or murder 2. This isn't complicated. If you don't agree with what's required to charge someone with premediated or intentional murder, then move to Nevada, run for the state legislature, and introduce a bill to change the language of the statute or the sentencing guidelines for DUI resulting in death.
