They can and they will. This will especially be the case later this year when the CDC fully approves it. Once that happens there will be no more excuses. Get the vaccine for your country or get the hell out. I can see the slogans now:

Trump lost, stop crying, get vaccinated cowards.

I would argue they explicitly can't. I guess they could just flat out ignore that? It wouldn't be the first time. We all seem to be making up the rules as we go along here.

I know they can't in Texas (thankfully). Governor already outlawed vaccine passports to preempt any frickery from the Feds. And from what I understand, the State (Texas) has the last word.

I'd rather not get vaccinated and then spit in someone's face when they cry about me not being vaccinated.

It's the FDA that will either approve it or not. Since you don't even know who it is that approves drugs I feel like your opinion on this is worthless.
