If it were his gun, and he wasn't charged with anything else, I don't have a big problem with it. He was probably pulled over and got the third degree from Barney Fife, and asked do you have a weapon and he told them yes.
After that I am sure he and the vehicle were searched and nothing was found, and he was not intoxicated. No big deal.

Cop smelled weed, searched car, found bag of weed in center console and gun under drivers seat
