That's true of breathalyzer/blood draws but not sobriety tests.

Any DUI lawyer, in Ms at least, will tell you to politely refuse every test. Yes you will be arrested. But if you're over the limit and test, you're gonna be arrested anyway. You have the right to refuse. As long as you're not falling down drunk on their camera or have shitliads of beer cans or whiskey bottles following out of your truck, just a decent lawyer will get you off. It will cost you of course a few grand depending on the quality of the lawyer but a good one will get you off. There will be no incriminating evidence.
