Restitution is also generally for objects that have easily identifiable fair market values (ie a house, a car, a plane, money, stocks, etc).

There is no readily available market for old oak trees. They clearly took the highest value for every input available and nobody could really argue with it because it is an ESTIMATE.

Again, whatever, I wouldn't defend the guy, but to argue that this is the normal cost for a big old oak tree to be replaced is silly.

someone throws an axe through a 300 year old painting. now put a value on a unique and one of a kind piece of art that has never been sold at auction. i mean you can buy some oil paint, brushes, and a canvas for $150
