Restitution is also generally for objects that have easily identifiable fair market values (ie a house, a car, a plane, money, stocks, etc).

There is no readily available market for old oak trees. They clearly took the highest value for every input available and nobody could really argue with it because it is an ESTIMATE.

Again, whatever, I wouldn't defend the guy, but to argue that this is the normal cost for a big old oak tree to be replaced is silly.
