I'm talking about kids who cannot get vaccinated suing the ones who choose not to.
Choosing not to is ignoring reason and a mountain of evidence showing the effectiveness with very rare risks of serious complications. That's negligence on the parents behalf.

That's a reasonable scenario, I'd have to think on it though.
