Yep. It makes sense, sitting here at my desk, to relegate the non-power conferences to FCS. But try convincing East Carolina, for example, that they have no seat at the grown up's table.

i would imagine the "power" conferences would all expand to 16 teams, at least giving you 80 D-1 teams, but yeah there would be quite the legal battle if that were to happen

They wouldn't necessarily be relegated to FCS, they would create a new division for the teams that get left out.
You could reasonably have 80 teams in the new division, and East Carolina would have a shot at getting in. Also, you wouldn't put every current Power 5 team in the new division. Wake Forest wouldn't make the cut, but a non Power 5 team like UCF would.
The split in the 80s was based on support, so things like stadium size and average attendance came into play. If we use the same criteria for the next split, a lot of current Power 5 teams would get left out.
