Depends on what your definition of "beat" is I guess. Mine is closed fist, violent punches, kicking etc. That's a felony every time, and Commings did no such thing.

No it isnt. I think you are assuming too much to the actual law. Yes sometimes a beating with fist can result in a felony but not all or the majority of the time. You keep changing your qualification for the felony BTW. First it was location, then size/man vs women, and now its the type of beating.

again, the reason for felony on one compared to the other was because he strangled her. that act alone pushed it up into felony status

I'm not qualifying anything. You're nitpicking a small part of my post and trying to make that the main argument. The only point I was trying to make was that CockinYourEar grossly misrepresented the Commings deal based on things I know to be true. The felony/misdemeanor cut-off really is extraneous part of that point, and I'm sorry I brought that up because it distracted from the point I was trying to make.

He did misrepresent the events, as he did not "beat" her or whatever he said, I definitely agree to that. but he did still commit the crime in accordance to the law

How so? He beat her. Witnesses told officers that he struck her. He was arrested for it. He plead guilty. That's pretty damn straight forward.

Three times? I said it would be a felony if he really beat her. The other things were just comments based on the specific circumstances. Obviously location or his size don't make something a felony by law.

Not really. Depends on the accounts you want to quote from. I've seen some that said they were arguing and she tried to get up in his face and he pushed her to get her away from him and she fell. The witnesses were friends of hers.

Context makes all the difference in the world, doesn't it? Pushing a woman to get her out of your face just doesn't constitute a beating to me...if it does to you, then so be it. It was a bad incident that never should have happened. There is a reason that drinking laws in many places are set at 21. (Not that people over 21 can't/don't act foolish while drinking.)

I feel like you're going to ask me to define the word, "is" next. Clinton tried this too.

He struck, beat, pushed, open-palm punched, assaulted, battered, whatever word you want to use. He plead guilty to battery, meaning when he intentionally caused substantial physical harm or visible bodily harm to another.
