You can't shoot people who are running away and have any sort of legal defense. They took his stuff. She asked him not to shoot her and then ran away, he then chose to kill her. We have a legal system to remedy theives.

Frankly, we don't have nearly enough information to really answer the question if you ask me. And I'm too tired to go searching for it and even if I found some, I probably still wouldn't have enough information. Anyways, here's why I'm giving up answering it for now:

Duke, I would only say we don't even know if they were in the house or if the woman was even running out of the house. Heck, for all we know at this point the lady was trying to stall him while she got a weapon of her own. If she got away, left the house and was literally running away, I'd stand by my earlier thoughts but I just don't think we know enough either way. Or I don't at least.
