I'm not a lawyer, so I won't give legal advice. But, lemme ask you this, approximately how much money do you think they cost you with their scheme?

Unless we're talking serious money, and by serious, I mean more than a month's wages, let it go, and move on.

Unless I'm reading it wrong, you're not on the lease and who gives a frick if he files for eviction on you?

He's not going to take you to court for damages, and I'm sure she's not willing to really getting evicted to spite you.

Pay back your ex, recover the money you really paid with the evidence (if you want to go that route) and move on.

Or am I reading this wrong?

Luckily, I had my own place prior to meeting her.
The only thing it cost me was $600 for movers, $290 for unpaid utilities for the month of May (as of now). So I would say only 1k or a little over.

We were on the lease. The landlord made the point that she wasnt accepting the rent from neither of us after I offered to pay it even though i wasnt living there. She took the payment from my ex even though she stated otherwise. So in the end, I only got evicted.

Don't hate her. That takes too much energy and gives her more of your time than she's worth. Instead, be grateful that you saw who she really was now and not 2 years from now. And pity her because she lost a great guy. That she'll never get back.

Totally not worth the hassle, unless you can prove that your credit has been damaged or something. Cut your losses, consider yourself lucky to be rid of her at such a bargain.

Ah got it, so you put yourself on the lease after you moved in?

Well, if your landlord is small time enough to get into some shite like this I'm guessing she won't be able to put anything on your credit.

Take your evidence as future defense against these scumbags and move on anyways. Take the L of the costs of moving out as an investment in sane pussy and move on. If the landlord comes after you in small claims you've got the evidence to get out of it and could probably get a countersuit filed for lost wages due to the incident and whatever court fees you incur.

ETA: Also, I'm pretty sure there isn't such thing as only one person on a lease getting evicted. If the rent is paid, it's paid. I'd be willing to bet on it. There are two tenants to ensure the rent gets paid, once it's paid I don't think the landlord has a suit against anyone since the obligation of the lease is paid.

Your Ex could go after you in court for your half of the rent in theory, but then you have that proof you mentioned.

At this point, who gives a frick. Perhaps this will sound cold, but at this point, the only concern you should have is the $$$, THAT'S IT. Don't try to get even, don't try to get an apology, don't try to prolong this shite anymore than you have to.

To ammend my above post, I would strongly suggest you send a certified letter to the landlord as required stating that you have moved out of the premises and are giving your 30 days notice (assuming that's stated in the lease.)

That should cover you from any additional shite should your ex decide to really get evicted. If you got free rent in the lease you may have to pay that, but I'm assuming you didn't.

Send a certified letter getting yourself out of the lease in the manner the lease prescribed. Hell, even if it's not in the lease, send a certified letter saying you're no longer there or willing to obligate yourself to the lease. It's worth the effort.

We were allegedly both evicted as per the court order.

When I hired the movers to pick up my items they said my ex was laying in bed and hadnt packed nothing. Currently, she still lives there.

Yea, im just gonna have to drop it and move on.

This was not about rent payment. It was about just getting me off the lease and the rent payment was an excuse.

If you're on the lease you can be sued. If you're evicted, you're both evicted.
If the rent was paid, you can't be evicted unless you've violated some other portion of the lease.

Send the letter.

See my above post. Send the letter giving your notice that you will be leaving the premises. Send it certified. The lease will give you the instructions on how to do it.

We were evicted for non-payment of May's rent. Rent was paid by my ex. She tainted the landlords opinion of me and I have the voicemails that she didnt delete off of the house phone.

If rent was paid, you can't be evicted unless you violate some other portion of the lease agreement.

There are really strong rules on these things regardless of the state.

Anywho.. My stuff is moved.. Power was turned off, since it was in my name. She did have my spare car towed so I have to drive all the way back over there to get it out, sigh. Then she texts me saying send me the floor mats she bought me.. Seems to me she is trying to find a way to get me to see her or come back to that side of town.
