The NLRB ruling is only applicable to private schools, since the NLRA doesn't include public institutions. That being said, should this go to trial and a court rule that college athletes have the right to form a union for collective bargaining...then the ruling could set a precedent for public universities, too.

It is. The Department of Education's going to have to declare athletes employees which is never going to happen.
