The Arkansas Times has a pretty interesting post right now about Circuit Judge Mike Maggio, a candidate for Arkansas Court of Appeals, and his posting history on tigerdroppings.com.
TL;DR: A judge posted a bunch of stuff on tigerdroppings including info about a celebrity's adoption. His speech on those boards may be up for judicial review.

The spicy comments — under the name "geauxjudge" on tiger droppings.com, a message board poplar with LSU fans (Maggio's daughter plays golf there) — have an obvious bearing on the commenter's judiciousness as a judge. But there's some question about whether comments made under a different name aren't protected on a judge's part as free speech. But revealing information about a confidential adoption proceeding is another matter.
Blue Hog isn't the first to be aware of this. I sent an inquiry to the agency that regulates judicial conduct. I got this response, which indicates a review was already underway.
The JDDC is aware of the allegations that were reported today. Under Rule 7C(3) I can confirm the pendency of an investigation by this agency. The judge will have full due process rights during our litigation of this matter. This office will not have further public statement until the case concludes with dismissal, agreed resolution or public charges.
David J. Sachar, Executive Director
I'm seeking a comment from Maggio.
Theron adopted her son, Jackson, in 2012 but news articles never revealed where the adoption took place. Early reports said the child might have come from South Africa, ,but she later said the child was born in America. She and Jackson appear frequently in tabloid press coverage.
Maggio is a candidate for state Court of Appeals, the state's intermediate appellate court. He is opposed by Bart Virden of Morilton.

NB4 - The Arkansas Times is a liberal rag.
I get the feeling that someone outed him to judicial conduct, and then the Blue Hog Report got tipped off too.

the offending post:

This was a confidential adoption, apparently. Not so much, I guess.

Well, he seems like an arse all around. I wouldn't vote for him based on his prior asshat actions. Posting on a public message board about private, confidential matters that he is privy to because he's a judge is the icing on the cake regarding his terrible judgment. Seems like he's way to concerned with bragging about his position which apparently overrides his sworn duties. Egotistical asshat. Would not vote for him.

Of course, there may be a slap on the hand or nothing at all to come out of this. His speech under an alias may be protected, but it sure doesn't help his court of appeals candidacy.
Blue Hog Report, the blog that tipped the case for Mark Darr's resignation, has cherry-picked screenshots of geauxjudge's posting history. It's not a fun read, knowing he's a judge in Arkansas.

Probably a slap & I hope he does not win the court of appeals position if he continues with his candidacy for it.
Litigator might have some insight into the free speech issue - what's protected & not.
Also, not too bright using the word "judge" in his username here, AND affirming that he actually is.

Good God, I just read all of his posts from that link. What a complete moron.
And unfortunately, a judge in Arky.
There might be some interesting conversations this week at my family's in Conway.
Maybe we should delete mine first.

I think his ego got the best of him and was he still riding that painted pony?

Upon further review, I'd vote for him and would go on a riverboat gambling trip with him and play in a scramble any day of the week.
We need judges with his brass balls.

There are really two different First Amendment issues in cases such as this.
The first is whether what a sitting judge says is protected speech. That came up in the case where Judge Griffen was sanctioned for commenting on public policy matters including the Richardson v UA lawsuit. That sanction was ultimately overturned on First Amendment grounds. LINK
The second is whether and to what extent the First Amendment protects an anonymous blogger's right to post without their identity being revealed. LINK
Both are developing issues and historically the safest thing for a sitting judge to comment on publicly anyway are those things which affect the administration of justice such as whether judges should be elected, whether judges should be subject to term limits, etc. It is not that it is wrong to comment outside of that area but it does put a judge in a gray area when they do so.
