And what extenuating details do you have, good sir? I see an observed traffic violation (right-of-way violation), observation of the crime of littering (the m.j. cig being tossed from the vehicle-which erases any illegal seizure BTW, IIRC), and possession of a controlled substance (mary sitting in plain view-no illegal search)...valid traffic stop was valid.

For the record I think mary SHOULD be legal. Until the kid moves to Colorado, however, he probably needs to lay off the green...

Does the Probable Cause affidavit state the officer actually observe the player in possession of the weed? Or just that the roach was tossed out of the window the player was sitting next to? If the courts in Alachua County are as liberal as down here, count on that case getting tossed.
