Georgia law makes it a DUI if you are under 21 and have a BAC of .02% or more. That is one beer and a bullshite law. A young college student shouldn't be facing jail time and a DUI record for drinking one beer. If you want to charge him with underage drinking, then do so. Georgia DUI law

Its to discourage underage drinking and driving. He was arrested on a violation of a law that exists. Whether you agree with it or not is irrelevant.

However I don't think he needs the book thrown at him. He'll get a pretrial program which will include community service, put on an alcohol course, and maybe probation.

He's a young guy who made a mistake that he'll hopefully learn from. I wish people here wouldn't go ballistic just because someone was arrested at a school that isn't the one they root for.

That's the law in Tennessee too. And it's not dumb. People, kids especially, don't need to be drinking and then getting behind the wheel of a car. Flirting with the grey area between being dead sober and legally intoxicated is irresponsible.
