The defendant in a law suit can't "tuck it's tail and run".

The state of Tennessee is suing the NCAA, not the other way around. The NCAA is stuck with the trial unless the state of Tennessee bails.

Sure it can. Defendants in lawsuits do it all the time.

The Biden admin itself has done it dozens of times.

They do something, they get sued, and they 'withdraw' the error filled ruling in hopes the judge will just dismiss everything as it's "no longer viable". It's worked over and over

This is what the NCAA will do. Withdraw the investigation. i.e. "tuck it's tail and run".
