Correct. And if the judge tells them not to bother because they stand no chance in the actual case, NCAA will tuck its tail and run, even if they win today.

The defendant in a law suit can't "tuck it's tail and run".

The state of Tennessee is suing the NCAA, not the other way around. The NCAA is stuck with the trial unless the state of Tennessee bails.
