And that's where the contracts need to be regulated more to not allow pay to play to happen without it being spelled out as pay to play.
It's not hard to look at a contractual requirement like that and say "No, that's pay to play".

It’s not pay to play. You can’t enforce that. It is what it is. It’s a loophole and they have no legal recourse.

So you want to do away with NIL? A bit late for that. You want to regulate it? What agency to you want owning a student’s nana image and likeness? The government? That would be ignorant of reality. The NCAA? They have proven inept.
The only way to regulate NIL would be for an agency to buy the NIL rights from each student athlete.
