This doesn't help fix the problems in college athletics.
If the membership including conferences and teams don't set some parameters and come together for the good of the sports they participate in it's not gonna work.

I realize teams are fighting for recruits but for the common good teams have to work together to make it sustainable.

It should never be about who wants to buy the best team.
Has to be some kind of multi year commitment from player to school in this environment to make it work. Even in professional sports there is player/team commitment set up in the contracts they sign.

Define the problem.

What needs to work? The only fix is that the NCAA buys the NIL rights in total as a condition of being an NCAA student athlete. And the NCAA doesn’t have the money to afford them.

TAMU tried it. Ole Miss is trying it now. Not an issue

Schools are not buying NIL rights and are not party to any agreements. Ergo the schools have no standing to enforce any 3rd party agreements.
