Depends on the policy. I have a whole life policy that I had to answer that question for. I’ve got a substantial term life policy through my employer that didn’t ask a single health question. I was worried about that too.

If the policy was taken out 10 years ago and he wasn’t at a tobacco user then but is now, how is this a thing?
