Sources say Miles tried to avoid the situation and did NOT pull the trigger. However, he was in the car and the gun was his, therefore he was charged with capital murder along with alleged shooter Michael Davis of Maryland.
Sources add that the district attorney plans to have Miles testify that Davis was the shooter and that that COULD result in the reduced charges against Miles.
Again, Miles reportedly tired to avoid the situation after an argument on the Strip, but his friend Davis refused to let it go.
The matter will have to play out legally, and in the meantime, both suspects are being held without bond in the Tuscaloosa County jail.
It is very unfortunate if that is true. Someone like that will only bring you down to their level.

Where are you seeing that?

He seemed like a really good guy.
When did that happen and why?

Well, hopefully it's true. If his only connection to the incident was presence and ownership of the firearm maybe he'll be able to plea it down to some kind of firearm or reckless endangerment charge and avoid long term incarceration.

The girls in the bushes were in the group with the other kids. One was killed.

Felony Murder Law Alabama
Miles can be charged under the felony murder statute of Alabama. The above example is from Indiana, but Alabama has the same law.

Yes, if he were in the process of committing another crime, he can be charged with felony murder, but he does have to have been in the process of committing a crime.

What crime was Miles in the process of committing when his friend fired shots?

This clip from what appears to be a news station in the DC area shows Darius’ friend being ‘perp walked’ while wearing what looks like a hospital scrub top. That would seem to point to him as the one with a non life threatening gun shot wound. LINK

Damn. If that's true, it's possible that it was the shitty company he kept that was the only real problem. In this scenario, I'd imagine the firearm was left in the car (not smart, but nothing criminal) and picked up by his friend.
IF this is indeed what happened, I feel bad for him. Shitbag friends can take you down with them.

Was this in Baldwin/Mobile county?

Don't know, but that's how that gets charged.

Maybe He was intoxicated?

Don't know. I thought it would have to be a felony for a felony murder charge to stick, but maybe not.
ETA: Maybe possession of a firearm while drinking alcohol?

Miles doesn’t have to be in the process of committing a crime himself, but accompanying someone who is and if it was his gun, that would make him an accomplice. Initial crime would be firing into an occupied vehicle.
If this is the case, I hope that the DA goes easy on Miles on return for testifying against Buzz.

Yeah, this whole legislation was an ignorant knee jerk reaction to crime problems. A person should not be held accountable for what someone else does. That is unjust.

It's very difficult for me to believe that Miles is a BAD guy. But, it's easy for me to believe that he would be stupid enough to get himself into a really bad situation like this.
We'll see when the details come out, I guess. Either way, he's clearly not blameless.
