WASHINGTON, D.C. - Sen. Rand Paul yesterday introduced S. 2644, the FAIR (Fifth Amendment Integrity Restoration) Act, which would protect the rights of citizens and restore the Fifth Amendment's role in seizing property without due process of law. Under current law, law enforcement agencies may take property suspected of involvement in crime without ever charging, let alone convicting, the property owner. In addition, state agencies routinely use federal asset forfeiture laws; ignoring state regulations to confiscate and receive financial proceeds from forfeited property.
I'm sure the tards on both sides will work to shoot down this since it helps the every day Americans.

It's a shame we even have to have legislation on this issue.

This is just for the feds right? It might actually get through.
The problem will be the states not taking similar action. Think the DAs and cops in this state will like that one bit?

I agree, and it is a bigger shame that half the country doesn't even understand what this is.

I'm a little concerned this is a 5th amendment defense act when it really seems to concern search and seizure, which falls under the 4th.

Yeah, that's confusing. Maybe a typo since they both start with F?

Finally, the Amendment requires that the power of eminent domain be coupled with "just compensation" for those whose property is taken.
quote:
nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
I guess this is where it's coming from.

Rand is also giving a speech at the urban league today. He will be discussing public schools, changing some of the issues with criminal law, and economic impact zones.
