It's that simple. The teams that ignore what little rules there are can take advantage and change the future of their programs.
But mark this down. It will not remain like this for long. There will have to be a governing body who will place rules and hold NIL collectives and Universities accountable.

I tend to agree.
I also believe the logical concern is if this governing body will have enough power to enact reasonable enforcement.

I think there was always a guideline regarding recruiting enticement (via NIL).
How we got to this point of some teams seemingly bidding for players' services is another question, because that practice appears to go directly against those handful of actual "rules."

Same thing happened around 1oo years ago
Super conferences were forming
Issues with pay for play were happening
POTUS and Congress stepped in and NCAA was formed.

The NCAA could have made things work but they wanted to make billions of dollars for the member institutions without paying players. There was too much money in the system and that was never going to work forever. Rather than making incremental changes themselves they fought it tooth and nail then the levy broke.

The solution is a roster cap of 60-65, limits the number of players allows for talent to be more evenly distributed.

Similar to what baseball did with the 35 man roster
It created a lot of parity and even smaller teams have benefitted
Only problem is football is such a contact sport and injuries could easily turn a 65 man roster into a team that struggles to field a team at certain positions

there are easy fixes to what is going on that does not go against the federal ruling.
The Ncaa can Change the rules of transferring and end the madness with one simple rule.

They could also put a limit on the number of times you transfer. I think JT daniels is in the portal again. USC, UGA, and West Virginia already. You should be able to transfer once and play immediately. After that, your case should go under some sort of review otherwise you sit a year.

within 3 years this will look very different. Why? It hurts the rich.
That's just a fact.
So the point to the thread is that the teams willing to go all out right now will move up in stature and be better situated after the "new rules are set.

I was wondering the same thing. Who is this almighty “they”?
I doubt “they” have more power than the Supreme Court and the SC has already decided players should be paid a “fair market rate”. If “they” step in and decide what that fair market rate is, that is price fixing and it’s illegal.

Yea.....nobody but the rich will care about that.
Something that helps smaller schools and hurts bigger schools will not persuade anyone but the elite towards your viewpoint.
Let's remember: the NFL is so popular because of the fact that you can't just buy a championship. It's a socialist system that they operate.

Players:
1. Traditional scholarship: no cut unless it’s classroom based or law enforcement issue.
2. NIL: can be traded, cut, whatever.

It always amazes me at how generally stupid the average CFB fan is. What you proposed is quite literally already in place.
You have one free transfer. Your second transfer will cause you to sit a year unless you are approved with an NCAA waiver.
You get one more free transfer if you graduate early.
