Vanderbilt. Having a private school in a conference shields intra-conference correspondence from FOIA requests.
In the ACC you have 4 (Wake Forest, Boston College, Miami and Duke).
In the Big Ten you have 1 (Northwestern)
In the PAC 12 you have 2 (USC, Stanford)
In the Big 12 you have 2 (Baylor, TCU)

That's why Rice, SMU, and TCU were pissed when Baylor made the original Big 12 cut but Houston wasn't.

Are you sure that FOIA applies to states and state institutions? I'm not sure that's right...

Yes, caused an uproar when UKAA when from 501 3 c to actually being part of the university. BCG, the gift that kept on giving, sorta like the Clap.

Well a quick google says no - FOIA only applies to the actual Federal level of the USG. States will have their own information availability laws and some aspects of what universities do may fall under FOIA requests of the Dept of Education but I'm not sure that federal FOIA applies in the sense that we're thinking. State versions maybe. But hey, I'm not a lawyer.

I thought we were talking federal FOIA which is what just about everyone thinks of when you say FOIA because you know, the federal FOIA is actually called FOIA and the state ones generally aren't...and they'll vary in composition by state.
How would adding a private school protect a conference from a state level FOIA equivalent request to the point that it's a wise financial decision? The juice doesn't seem like it's worth the squeeze considering that most important information in situations we're thinking of could simply be subpoenaed, even from a private school/org.

I think most people look at FOIA laws from an individual state. That's where the majority of law and reporting is practiced

If we're being honest, no founding member can be removed. We are still the SOUTHEASTERN CONFERENCE and loyalty to our brethren and sistern in arms (it's us against the world not just in football but in terms of just a southea firn mindset).
It would also do irreparable harm to remove a founder -- more than any other sport CFB relies on region, pride of place, and a sense that our teams are a large part of our identity but it holds for our conference in general. (I could go on with that point but y'all get it).
If we were ever forced to shrink it should be expansion I & II teams being debated. Not because they don't belong but because it's hard to erase 100 plus years.
