In short, no, because he was no longer bound by his NLI because he had been ruled ineligible initially.

Not according to the article. Said he is still bound by his NLI of intent since he won his appeal.
I do agree, that even if they did do something wrong, it is very minor.

I think the article is mistaken about a couple different things. One is the eligibility ruling and how it impacts NLI, and the other being who contacted who first.
