LSU's statement is entirely predicated on the evidence that is available today.
That tape has not be turned over by the FBI to anybody. They don't even want to play it in court because it helps the defense. As of now, the FBI and SDNY consider the universities the victims in all this.
Now, all of that may change. The feds may turn over what we've heard about from Yahoo and more. It could happen. But it doesn't seem likely right now. And LSU had to act based upon what they know now. The only holdup was Wade coming in to tell his side of the story with the NCAA present (and presumably asking their own questions as the NCAA does).
But to really answer your question:

Nope.
The only evidence (the transcript Yahoo allegedly received) has yet to be turned over to the NCAA and we don't know that it ever will be. The feds so far seem to think it only benefits the defense (who no doubt was the one to leak it to Yahoo). The feds are arguing against having Sean Miller and Will Wade testify.
Again, this could change. LSU made it quite clear in their statement that their decision was based on the evidence as of today.

Exactly.
Getting caught in his lie is what doomed Pearl at Tennessee. Wade may well get caught too but that hasn't happened yet.

You mean, IF he did it?
To your point, a great defense lawyer would have kept the tape from ever being admitted as evidence and even if it did he'd convince the jury that the cops might have altered or fabricated evidence because something something racism.
Or you could just do like Remy in "The Big Easy" and have a giant magnet placed next to the tape in the police evidence room.

Has nothing to do with the NCAA yet. LSU can't keep a man from working if he hasn't been proved guilty of something. The statement said his answers satisfied his requirements to the University not the NCAA. They sure as hell wouldn't fire him if they're still on the hook for his buyout.
Notice the release said 'barring actual evidence'; that clearly means that LSU felt they couldn't avoid the buyout.
Until and unless something tangible and verifiable comes out, it would be LSU breeching the contract.
Something else I pointed out in another thread- LSU talked to Smart, and they talked to the apparent middleman. No dice from them.
The tape excerpt was too vague to commit to, and the actual tape is and will remain sealed. The FBI wiretapped Christian Dawkins, not Will Wade. Parts of that tape not related to Dawkins' crimes are not open game, that violates federal law. If Wade confessed on that tape to an actual criminal offense, it would be different. But outside of that, the Feds will keep it nonexistent.
