Well, dui laws are 95% moneygrab, 5% public safety.
Whether he was actually doing something wrong depends on the details.
Ftr, I got arrested for dui several years ago when I blew under the legal limit. Cop had already had me do field sobriety, he was part of a DUI task force. By the time he got me back to the station where I could actually blow, he had already invested an hour in the transaction and was going to cite me no matter what. Blew under the legal limit at the station, but still spent the night in jail, paid bond, and gave a lawyer 2k to represent me and get it thrown out in court.
Whether he was actually doing something wrong depends on the details.

My dad was run over by a DUI. My dad was also a cop, who had arrested the DUI a-hole 6 months prior. The chief dropped it, because the DUI a-hole was a prominent member of society.
