There is no such thing as innocent till proven guilty, fifth amendment rights, right to a trial by jury, right to confront your accuser, inadmissible evidence, due process, etc etc. The NCAA is a non-profit organization that can set, or ignore, or change its own rules as it wants to. It is not a government body bound by the law.

They can be sued. That kinda gets back to the rule of law. Just saying.

They also punish for not answering questions and not cooperating within the spirit of the rules.

True, but the NCAA is still subject to the law. The NCAA can be sued for applying its rules arbitrarily just fyi.

ETA:

That oversimplifies it. You cannot be sued for no reason, and if you are, the opposing attorney can get sanctioned for filing frivolous claims.

Yes, but the NCAA can (and does) use evidence gathered by government entities with subpoena power it doesn't have.

So can your HOA.

How is that different than any organization? They can be sued...and attorneys can be sanctioned for filing frivolous claims against any organization.

The NCAA has every right to arbitrarily apply its rules. It is a private organization with voluntary membership

EVERYONE and ALL ORGANIZATIONS are bound by the US Constitution. It is absurd to think otherwise.

When a person has received a subpoena, it certainly gives that person standing not to talk to his or her boss about the matter so as not to unintentionally contradict himself.

so the NCAA is not bound by law? You might want to reword that.

Wouldn’t Will Wade’s employment with LSU be subject to the constitution?

No it does not. A person is free to choose not to talk to their boss without being arrested, they are not free to not talk to their boss and keep their job

No. Could Will Wade walk into Joe Alleva's office and use racial epithets and keep his job? No. Can Will Wade use racial epithets and not get arrested? Yes
