Not 100% sure all the legal crap meant but it sounds like a narrow set of items that it applies to. Basically sports clothing or memorabilia that have the word "the" set by itself. Sounds dumb but trademark law is weird.

FFS, it only applies to very narrow circumstances and items. Sports clothing that have "THE" clearly set apart to accentuate it. A shirt that says "The Fighting Tigers" is OK.
A shirt that says "The...." on the front and "...LSU Tigers" on the back is not so much.

Can you clutch your pearls a little harder? The word "baggy" is trademarked and nobody claimed it was the sign of the apocalypse when it happened. And I hate to have to explain it to you but you don't get sued for saying a trademarked word any more than you would get sued for saying "I like my iphone".
