and the NCAA somehow gets ahold of it,

It's obviously been taken in a very illegal way, but the NCAA isn't a criminally centered organization.

Can the NCAA use what is given as actionalbe proof or would Reb lawyers tear them a new hole for using ill gotten gains?

They can use whatever they want. They have no legal obligations as far as what evidence is and isn't usable.

He's right; the NCAA is the convening authority for the member schools and the schools play by the NCAA rules.

I just don't know if this doesn't turn into a death spiral for both if the Rebs push back on HOW the NCAA gets the goods.


all hypothetical for now, but it's gonna get messy one way or the other if this does happen.

Not going to happen.

The NCAA won't touch this with a ten foot pole. Not unless Ole Miss self reports something for the PR benefit, at which point the NCAA will agree with whatever sanctions Ole Miss self-imposes.

People just need to accept that the NCAA is a paper tiger.

Would actually be interesting. If the NCAA used illegally gained evidence to punish Ole Miss, I wonder if Ole Miss would drag them into court

I may be wrong but I don't think you can get text message screen shots off of iCloud unless they were snapped and saved to your photos in the first place.

If that is correct, why the hell would Tunsil screen cap something that incriminating? What was his end game?

with the money at stake, I think it would be a near certainty.

Also, Boxer is right. The NCAA has just been eviscerated lately and they cant do a damned thing right. But that could also work against OM; maybe the NCAA tries to bow up and grow a pair for old times' sake.

OM would lose that case. The NCAA is the governing officials of college sports. All of the teams agree to play by their rules and they are not bound by any legal body on how they determine punishment.

Nah, they played fast and loose with the law on the Miami case and people lost their jobs.

No way people are going to risk their jobs for fricking Ole Miss.

Not necessarily, if they can argue that it was an arbitrary ruling / the NCAA is not consistent in their penalties. If nothing else, it would be interesting to see what the NCAA is forced to release under discovery

They may be but I can't accept it, do something you pathetic pussy of an organization.

(When I say do something, I mean that as in valid proof exists and they've verified it. I don't want them just willy nilly slinging mud at stuff that's very minimal. Which gets me to another point, they need to redo their rules and try to use common sense when altering them or making new ones. Why even exist if they don't do anything? Exit soapbox...)
