Gridiron Now’s Jimmy Hyams reported Sunday that the victim, Smith’s friend and roommate Kennedy Foster, has threatened a $3 million civil lawsuit if the player doesn’t pay $875,000 in compensatory and punitive damages by Tuesday.

If the $875,000 is not received by 5 p.m. Tuesday, along with a “letter of sincere apology,” then the offer will be withdrawn and Foster and his attorney will file a civil suit seeking $1.5 million in compensatory damages and $1.5 million in punitive damages.

Foster also tried to press charges against Stokes, though his attempts were unsuccessful. Given that, Stewart said it “looks like” like a case of extortion with Foster, though he also stated that he was not accusing him of that.

Smith was charged with domestic assault after he was arrested in the early morning hours of May 6 following a fight with Foster at their off-campus residence.

Foster, who was hospitalized at UT Medical Center following the incident, suffered a broken nose, broken teeth, and damage to his eyes and right ear, according to Underwood.

Foster was taken to the hospital by Smith’s parents, Butch and Jennifer Smith.

Smith, Foster and Malcolm Stokes, another roommate, had been drinking together ahead of the fight, which stemmed after Foster’s locked bedroom door allegedly was knocked down by Smith. Smith, according to the incident report, was trying to check on Foster who had said he was not feeling well.

Smith has 58 catches for 721 yards and five touchdowns for his career.

The roommate works for Smith and Hammaker and his parents asked Butch Smith for a job for life the next day according to Hyams lol.

I saw that

My best friends dad is close with Josh's old man. It sounds like they're trying to extort his parents. The Smith's are about to get the best lawyer money can buy if I had to guess.

I don't know them well but I know that the family has done a lot for the roommate over the years back to Josh's high school days. Basically taken him in.

Yes his dad is a business owner here in town (Smith & Hammaker which he founded with former Giants pitcher Atlee Hammaker).

Smith and the roommate went to CAK, a private school here, together which makes this a little surprising to me.

Interesting, thanks for sharing. Do you think Smith will get any pro looks? I'm guessing he still has another year left?

Even if he gets more than standard compensation for medical bills which the Smiths would've likely done for him anyway, I bet he'll regret doing this in the long term. It's a fight with someone you've been friends with since high school and you're throwing that and your relationship with people who've done nothing but good by you away for suit you're not going to get much out of.

This kid has been seriously misled if he thinks he'll get more than medical bills and a small amount (30-100k max and minus out 60 percent to the lawyer) out of this.

If he has a good season he can but Smith is an odd one. He's had one really good season in which he was healthy but has spent most of his career injured. He wouldn't be a high round pick in any case but he might be a guy that could sneak into the draft with a good year. I'd say right now his best bet is as an undrafted free agent.

Don't want to speculate too much here but definitely seems like the Foster family got some bad advice here.

Honestly, the lawyer here has balls. Who the hell says pay me 875k by X day and time or face a 3 million dollar suit? That is a line out of a movie not real life. And it's a bad villain line to boot.

Honestly curious, does smith not deserve to be at least sued in lieu of doing prioson time? Sounds like open and shut felony assault case..

I'm sure he's facing both although a first offender in TN isn't likely looking at prison time for something like this whether he/she is famous, infamous, or never heard of.
