Gridiron Now’s Jimmy Hyams reported Sunday that the victim, Smith’s friend and roommate Kennedy Foster, has threatened a $3 million civil lawsuit if the player doesn’t pay $875,000 in compensatory and punitive damages by Tuesday.

If the $875,000 is not received by 5 p.m. Tuesday, along with a “letter of sincere apology,” then the offer will be withdrawn and Foster and his attorney will file a civil suit seeking $1.5 million in compensatory damages and $1.5 million in punitive damages.

Foster also tried to press charges against Stokes, though his attempts were unsuccessful. Given that, Stewart said it “looks like” like a case of extortion with Foster, though he also stated that he was not accusing him of that.

Smith was charged with domestic assault after he was arrested in the early morning hours of May 6 following a fight with Foster at their off-campus residence.

Foster, who was hospitalized at UT Medical Center following the incident, suffered a broken nose, broken teeth, and damage to his eyes and right ear, according to Underwood.

Foster was taken to the hospital by Smith’s parents, Butch and Jennifer Smith.

Smith, Foster and Malcolm Stokes, another roommate, had been drinking together ahead of the fight, which stemmed after Foster’s locked bedroom door allegedly was knocked down by Smith. Smith, according to the incident report, was trying to check on Foster who had said he was not feeling well.
