A number of Ole Miss supporters believe that the NOA 2 charges will mostly disappear when Leo Lewis, fearful of being charged with perjury, will, under oath in his deposition, or in response to questions at the COI meeting, recant his narrative that he received free goods from Rebel Rags. Presumably this will happen because RR will show that they didn't give him such goods, and Lewis's statements have inconsistencies.
Is there any strong reason to accept this prediction? Is there any real reason to expect this outcome.
I'm not sure perjury threat is all that strong, even if Lewis is lying. Prosecution for perjury in connection with civil law suits is exceedingly rare. Proving that someone intentionally lied under oath is very difficult to prove beyond reasonable doubt. In almost every litigated civil case, someone is probably lying or at least shading the truth, and almost never is someone actually prosecuted for perjury in such cases. In this case, I doubt inconsistencies would be enough to entice a DA to prosecute. And pretty much the case comes down to he said/he said. That makes proof beyond a reasonable doubt very difficult and is a main reason prosecutors don't waste their limited resources on such cases. So while some are hanging their hopes on this rather thin thread, I don't see fear of perjury charges as likely to shake Lewis from whatever he may have said to the NCAA.
