UPDATE: Texas Judge Dismisses Chavis' Suit Against LSU; Case to be Heard in Louisiana

quote:

LSU scored a major victory against Texas A&M — on a Friday afternoon in the middle of August — but John Chavis’ attorneys are vowing to fight back and plan to do it during football season.

Texas judge Travis Bryan III dismissed Chavis’ suit against LSU on Friday, tossing out the case on grounds of jurisdiction and sending the legal squabble between the school and its former defensive coordinator to Baton Rouge.

“LSU is very happy with the result, and we believe it is the correct result,” said Bob Barton, a lawyer representing LSU.

The case will now be decided in Louisiana, a home-field advantage for Athletic Director Joe Alleva and the Tigers. Chavis attorneys plan to appeal the decision, said Jill Craft, the coach’s attorney in the Louisiana case.

LSU won the first battle fought in a Louisiana courtroom between the university and former defensive coordinator John Chavis.

A judge on Monday denied Chavis’ request to stay LSU’s suit against him in Louisiana, continuing the parties’ legal battle in two states – Texas and Louisiana. Chavis attorney Jill Craft plans to appeal the ruling from State District Judge Timothy Kelley.

He also expressed the court’s “concern” over the jurisdiction of the case in Texas.

“The court is concerned there is any way the Texas court can keep this case,” Kelley said. “I don’t see how they can have jurisdiction.”

Haven't you heard? We're broke. We need that $400k to make sure our children don't go hungry.

He owes us money, why should he not have to pay something that was in his contract if he left like anyone else has to and normally does?

In the end this all goes on A&M screwing Chavis over by not just paying this for him which is 100% normal procedure in coaching changes like this. It's $400k, drop in the bucket, but they are dragging this out to the bitter end.

Because some barely literate retard on a message board thinks it is unbecoming. THAT'S WHY!

If it is like a real divorce the first wife in Knoxville will want a cut of any money.

Legal eagles tell me that she's great at resolving issues early in cases but really struggles when cases are litigated through verdict. It was only natural he would select her.

I almost hope LSU gets that 400 K. I can't imagine how hard the poor bitches will melt if they lose Chief AND their suit against him.

If the situation was clear cut A&M would have paid the buyout.

When he officially quit, and when he officially went on A&M's payroll to become an employee, all support Chavis's side. LSU is hoping for some de facto ruling of his A&M employment starting earlier because they have pictures of him recruiting or something. In any normal situation the LSU party would not be chasing this.

You wannabe legal eagles make me laugh. Suits regarding whether someone breached an employment agreement happen ALL THE TIME. In the normal situation, these issues are litigated until resolution. You couldn't be more wrong. Saying something repeatedly does not make it true.

ETA: No one with any sense lets go a claim for $400,000 in this context. You guys are dumber than a box of rocks.

I wasn't talking about employment in general, I am talking about in the field of college football coaches. Often when buyouts aren't clear it doesn't go to court in this field. Programs settle.

Texas had that problem recently with their OLine coach, it went to court. I don't recall any SEC program having a suit like this once recently, but I could be wrong.

Yeah we have never in our lifetimes seen an athletic department with this level of delusion unrealistically refuse to pay a mere 400k that it is obligated to pay under a contract.

Never

Probably has more to do with LSU feeling like Chavis didn't completely fulfill his contracted duties to the very end. Example: being on the phone with A&M the day of our bowl game. If he wouldn't have left in such a shitty, dick head way, we settle with A&M, IMO.
