Neal told Caldwell to back off.

Caldwell attacked Neal.

Neal shot Caldwell, and Caldwell ceased to be a problem for anyone other than the morgue.

Investigators have confirmed that Neal has a license to carry a concealed handgun. He has not been charged in the shooting. Don Martin, public information officer for Tyler police department, said that Texas “stand your ground” laws may be raised in this case. “He felt that he was in fear for his life….” said Martin.

Tyler criminal defense attorney, Bobby Mims, said that Texas law can protect those who use deadly force when they reasonably fear for their life.

“Generally the law in Texas is that you may use deadly force in some instances,” said Mims. “You have to have a right to be there wherever you are; you have to be lawfully carrying your firearm; and you have to be in fear of your life, protection of others, or property.”



This would seem to be an open-and-shut case, so it’s doubtful that the media will be able to spin this into much of a controversy.

Caldwell acted erratically in numerous locations in front of a significant number of witnesses, went after Mr. Neal in front of witnesses, and then pressed his assault after Neal presented a weapon and declared his intention to defend himself.

Neal fired one measured, accurate shot, so it is unlikely that there is much of an argument for excessive force.

Based on the details of the case, this seems like a very legitimate case of armed self-defense against an unarmed attacker.

It will be interesting to see the results of the toxicology screen that they will do during Caldwell’s autopsy.

When you were reading the story, before you got to the picture, were you thinking the thug POS was white or black?

What if this were a black thug rather than a white thug - how would this be handled?

Finally, Fredy Neal, the 65 year old senior who was at the Red Box and who shot Caldwell, was he a white senior man or a black senior man?

I've got some more coming on this story once I get some feedback from y'all.

The old man did right as far as I'm concerned. The Texas media will spin it for gun control just because and I'm betting on either meth or opiates

He absolutely got what he deserved. I hope he got it before spawning a bunch of mini doppelgangers, but somehow I think that is just wishful thinking.

I don't know why people still screw with old people in the south. Don't they know the old timers are packing? Do they never watch the old kung fu flicks where the crippled old guy is the baddest mofo in the movie?

You're using the word "thug" wrong.

Yeah, for some, but I use it interchangeably with POS or other phrases like that.

I guess that's just one of those things that rubs me wrong when I hear it. Especially when I use it and get accused of meaning the other, which has happened multiple times.

I happy to say that even if we are looking at a black shooter, no one here will give a damn.

You have one idiot, who happens to be white, assaulting another individual.

I and the people in my circle would pat the shooter on that back, hope his mind isn't too fricked from the incident, and tell him he did the right thing.

No doubt. I've been in the minority condemning a lot of these "stand your ground and/or self defense" shootings, but it reads like this guy showed some restraint before pulling the trigger. The "victim" had a chance to flee and instead tried to escilate. He won the prize he deserved.
