Is it worth going to court over a seat belt violation?

Just got a ticket coming back from the gas station which is about 1/4 mile from my house. Trooper said he saw me pull out of the parking lot without it on. I told him I put it on as soon as I pulled out, which I did. Still gave me the ticket. It's only $46, but it's the principle. I'm freaking pissed. Guess I should be happy I didn't get shot.

It is if the Trooper don't show. At least that's how it works here. If the LEO doesn't show up for the court date, the citation is tossed.

I fought a speeding ticket (which I totally deserved) in court and the cop didn't show so I got out of it. Maybe I got lucky but I'm gonna do that from now on.

If you go to court and it gets dropped you'll end up spending more than the ticket on court costs.

It's a non-moving violation I think so it won't be a hit on your record.... I'd just pay and move on.

Generally this is true. How much is your time worth? Do you want to spend up to 4 hours in a dingy courtroom with a wonderfully diverse cross-section of society on a week night? Or take time off during the day for this? You should probably pay it and move on...

HOWEVER, I know in one instance where either Arkansas or Missouri dinged a driver for improper equipment (tail light out), and it stuck points on his license. Check with the state department of public safety and your insurance agent to make sure your license or your insurance won't be affected.

You are supposed to have it on when you are on the main road. That does not include the process of 'putting it on'

This. I do this all the time. I know one day it will burn me and I will be in your situation. But what I won't do is confess to the officer like you did.

So in your case I definitely wouldn't go to court. All he had to do was write down your statement in his ticket log and you have no hope.

What's the principal at stake? It was a dick move to write you a ticket if he saw you in the act of putting it on, but as others have said you did commit the offense for which you were cited.

You could go to court and have a chance of getting a sympathetic judge and winning, but that chance is pretty slim.

Just pay it.

I do not believe it should be a crime - adults can make their own decisions about their health and safety.

But I have changed my mind about wearing them myself. I've seen people survive unbelievable accidents with them on. I've seen deaths in relatively minor accidents without them. Looking at the statistics, only a fool would routinely drive without one.

I've been to municipal court a few times. Incomplete stop/ rolling through a stop sign.

Cop didn't show up...dismissed. But while I was there this kid had a speeding ticket. I think it was his third or fourth and he had a lawyer. That guy was sharp as hell. Brought out Georgia statutes about the visibility of radar detection. His lawyer had hired a surveyor who had written and notarized his findings, line of site from the crest of hill, distance the officer was from visibly, statutes stating the distance between speed limit signs (bottom of the hill 55, midway up the hill 45, just beyond the crest of the hill 35). It was a "You can't handle the truth moment". If I had stood up and started clapping, everyone else there would have joined me.

Sidenote, I went to fight a public drunk ticket. They spent a couple of hours marching orange suited vagrants in front of the judge.

"30 days or 30 dollars". Honestly, these guys wanted 3 meals a day and a roof over their head.

I cannot say that I am enabling, but if you get the chance to work for an entity, I don't care who it is...that provides a boiled egg, a piece of fruit, something that they can stick in their pocket and live another day, you are helping "the lesser of us".

Go to court, you might learn something.
