In Ohio, mom sues sperm bank for having interracial child

Jennifer Cramblett thought she was being inseminated with a white man's sperm in 2011 and only discovered after she was pregnant that the Midwest Sperm Bank sent the wrong batch, according to the lawsuit filed in Cook County Circuit Court.
The child, Payton, is now 2 years old and already experiencing prejudice in Uniontown, where 98 percent of the residents are white, court papers say.

Well, if she flat out stated that she wanted sperm from a white dude, then she probably had very good reasons for wanting a white kid. I think she has a definite case.

Not sure how anyone could think this suit isn't completely justified.
(If she made this clear to the sperm bank and they made it clear that they wouldn't provide her sperm from a black man.)

Plot twist... They actually sent the right batch, but the delivery guy had a BBC and she couldn't control herself...

The question of damages is going to be interesting.
Pretty sure that the sperm bank was negligent especially if the mother specified which batch she wanted.
But how do you quantify damages for something like this? It's definitely not as simple as a personal injury case where medical bills and such can be introduced into evidence. In that case, damage would have to be limited to intangible factors like "mental anguish" which has got to be tough on the kid when she finds out later after getting older.
But yeah basically what I'm saying even if you win the lawsuit, damages for it would be a total crap shoot. If the jury decides that's it's not that big of a deal all she'd get was nominal damages and a refund from the sperm bank.

My niece has to go to Atlanta to get her hair done. Apparently, it's a big deal to work with the biracial hair. No one in Bham can do it right (black or white).

frickin A she should get damages. Not because the semen is from a black man. But because its breach of contract. She wanted a child of the same race.

I don't think anyone is arguing that she should get damages because it was a black man's sperm. You don't just check a box at the sperm bank. She picked out a particular guy and they sent the wrong batch.
They don't have big cum vats in the back marked black and white.
