Long story short, the commonwealth attorney's office is trying a man named Dejuan Hammond for the 3rd time due to an absolute clusterfrick between missing witnesses and prosecutorial misconduct. He's accused of orchestrating the murder of a state's witness in 2009 by hiring a 16 year old to kill a woman testifying against his brother in his brother's murder trial.

Just to give a little snippet of why it didn't work the first three times:

quote:

His first trial fell apart last year because the commonwealth attorney’s office couldn’t find two key witnesses. His second crumbled in April when prosecutors unearthed a police report, never before seen by the defense. It revealed Hammond’s girlfriend at first told police she knew nothing of the killing before she changed her story and became a primary witness against him.

Hammond's attorneys are looking to get the third trial scrapped as well:

quote:

Hammond’s attorney, Ted Shouse and Annie O’Connell, have meanwhile asked the judge three times since the April mistrial to scrap the murder charge against him, charging that prosecutors were intentionally hiding evidence that might help Hammond’s case. More documents emerged, some of which the judge conceded were wrongfully withheld for years.

Circuit Court Judge Angela McCormick Bisig repeatedly declined to dismiss the charges, finding instead that the defense can detail for the jury all the ways in which they believe overzealous prosecutors overstepped their bounds.

LINK

Then this week it became news that the trail has been delayed again due to the accusation that Hammond tried to bribe a current witness with $90,000 to not testify against him. They will go back to court in November after the defense asked for a continuance.

LINK

So this son of a bitch paid someone to murder a state's witness in broad daylight, bragged about it to others (part of what got his arrested), and had the absolute nerve to try to pay off a witness in the state's third attempt at a trial.

It's a pretty fricked up world we live in when someone thinks they can be so brazen.

They do. And I wouldn't be the least bit surprised if he walks when it's all said and done because of them either.

He hasn't, I have. It's been a few years but I got to eat in the Al Capone Room for a wedding rehearsal dinner.

A friend of mine from college is the head bartender there and has gotten a few articles written about him. Just thought about it when you mentioned the Ville.

In all seriousness, it sucks the way that the system cans A) be effed over B) have a bunch of effups running it.

I'm pretty sure that's what happened with the first two witnesses in the 1st trial that "disappeared".

Looks like this guy is punking the police and prosecution, and getting away with it.

They need to put the dirty cops (or the ones that toe that line) on this case.
