Political preferences thread got me thinking.

How would the courts handle a gay couple divorcing and property rights, nonetheless parental rights?

Obviously we're not far along enough in most states to see the divorce statistics right now but I would be curious if some of the results of those cases would cause men to appeal some divorce rulings based on sexual bias revealed by equal divisions as a result of gay marriage.

It should be exactly the same as a normal divorce.

if I were a divorce attorney, I'd be all for gay marriage. Talk about a Golden Goose being adjudicated into your wallet.

Y'all say like a divorce "should" be.

We all know if there's a divorce and the father can't prove the mom is a coked out whore, there's no way he's getting 50% custody or money.

In that case, the nancy of the pairing should get custody.

How would gay divorce be any different than heterosexual marriage dissolution? I am assuming the same laws apply.

This isn't the case so much anymore especially with older children. Mothers are not automatically considered the better parent. Got joint custody and even split in mine.

They definitely shouldn't be given automatic custody. I've seen some beasts get custody just because they have female genitalia when the fathers would have been much better single parents.
