NCAA loses the O'Bannon case

The ruling is that the NCAA has been violating anti-trust laws and their rules prohibiting athletes from profiting from their likeness are illegal.

It shouldn't be that shocking, considering the NCAA had really no defense of their horrible practices and policies they've been engaging in for decades.

Their cartel of making billions off free labor is hopefully over.

It's hard to predict what will happen exactly, but it seems players will now get a cut of the money they generate held in trusts for them until after they graduate.

Let me get this straight, if their image was used, then they are due compensation. If their name appears on a jersey or in a video game, then they are due compensation.

At what other instances are they due this compensation?

The NCAA has never included actual names in games and on jerseys and thought that gave them legal cover, but that ain't gonna fly anymore.

Agree.
I also agree with the decision, though, from a legal perspective. I am sad to see this open the floodgates, but I can't disagree with the legal decision.

I posted this in the other thread, point 2 being relevant to the last few posts.

1. The NCAA will lose all the appeals, they had no case at all, and all legal experts said their defense was pathetic and non-existent and totally expected them to lose.

2. College athletics will not cease to exist, it's way too popular and profitable. All the gloom and doom stuff out of the NCAA was purely scare tactics. The NCAA, the conferences, and the schools will just begrudgingly give up a cut of the money to the players and grumble about the good ole days when they were allowed to give them nothing.

Couldn't the NCAA just change the way they market? Move away from individual profiles and use team stuff.

I don't care if they get paid for being in a video game (hell, they can add their names now if they are paying them). That's all they should get tho.

It was painful having to listen to JC Copeland bitch about how he wasn't getting paid in class. Like he would be anywhere near where he is today without his free ride

So very true. Meanwhile half that class is going to be in debt for most of their life while trying to pay for that exact same education.

So basically the NCAA has to ask permission to use an athletes likeness now? Athlete signs a waiver, etc. or not.

This is somewhat of a bittersweet win IMO.


The NCAA, if they don't appeal or ultimately lose an appeal, goes down in glorious flames as far as what they can and can't do with an athlete. Then again, it's more of that player entitlement and compensation (where it's headed) bullshite.
