It was a Christian counseling talk show on XM channel 131.

As far as I can tell, they were doing something having to do with their house's financing and she asked whoever the officiator was why she didn't have to sign anything and she was told it was because her name wasn't on the mortgage and her "husband" wasn't even married.

She did some digging and found out he divorced her 27 years ago and never told her.

I don't know who's the bigger idiot.

Most states require you to sign/know about it so I'm wondering how the hell that happened? Did he declare her dead or incapacitated?

Lady was too pissed to make much sense. She was asking if she should approach him about it or just leave it alone. The hosts were speechless

^She may have signed not knowing. There are a lot of people who are functionally illiterate - they can read only enough to do day to day stuff.

If they have been living together as man and wife for that long after he supposedly divorced her without her knowledge, they are common-law spouses by now anyway.

She is going to be madder when she finds out after the divorce he married somebody else and can not be charged with bigamy. If he was with the second woman, the first would be an affair, and she might not get anything as claiming common law would make her the bigamist.

Depending where they are locating determining common law marriage is difficult.

Not all states observe common law marriage. In Alabama, I believe that there is a stipulation that both parties must agree to be husband and wife.

Eta: Apparently only 11 states and D.C. recognize common law marriage.

What's the point of divorcing and then to live out your life as if you are still married? Money? Having the house and car only in his name?

Doesn't make much sense
