More on Mike Maggio (geauxjudge) Speaking to the issue generally it is doubtful that where judicial misconduct is found to have transpired it is going to lead to the overturning of a verdict unless it occurred with regard to a particular case. The latter part of this old law review article contains some good information about judicial misconduct in general. LINK. The same holds true of attorney or prosecutorial misconduct as well. You normally don't see the mass overturning of verdicts. Part of the reason may be because there has to be finality to cases and after a certain period of time has passed it becomes difficult, if not virtually impossible, to reopen a case. It was brought up in a prior post about campaign contributions to judges and their potential effect on a case and that was addressed by the US Supreme Court a few years ago where it held due process mandated a judge's recusal from a case where he received a large contribution from one of the litigants. LINK. In Arkansas you most usually see claims of judicial misconduct brought up in two forums. First, it can be raised in a particular court case and litigated there (and potentially thereafter in an appeal of the case to a higher court). Second, a complaint can be brought with the Arkansas Judicial Discipline & Disability Commission and if a violation is found to have occurred the sanctions range from public censure or reprimand to removal from the bench. The decision of the Commission is appealable as well.
