Who cares? Trademarks don't work like patents, it doesn't matter if someone else used "12th man" at some point beforehand unless they bothered to register it or start selling 12th man shite.
He's also talking about Seattle invalidating because the "info on the aggy trademark filings is false" which is full retard. I've filed tons of trademarks. A trademark filing consists of the mark you want to claim, a description of the goods you want to claim it for (shirts, bumper stickers, w/e), and a picture of your goods. There's no "give us the storied history of your trademark" field.
