FYI, Hollywood Dave in hot water

For those of you who find yourselves removed from Fayetteville, NWA, and the happenings at the university, this is a little FYI. It is a convoluted story, but I think it is important it be told in a clear manner



This is our current UA chancellor Dave Gearhart. If you didn't know this, you probably don't know WTF the rest of this post is about either

UA Works to Correct $4M Advancement ‘Miscalculation'

The University of Arkansas "University Advancement" division recently came under fire for budget overruns on the order of $4 million. These were brought to light in December of this year

Interviews with UA spokesman John Diamond and Gearhart revealed that a $3.1 million budget shortfall in the Advancement Division that had built up over two to three years was discovered in late June and was covered by tapping into reserve funds.


Remember Diamond's name, it will be resurfacing in a major way later

“Brad was being told by his budget person that there were funds to cover it, when clearly there weren’t,” Gearhart said. “You could debate the issue of what his knowledge should have been. I think he would claim that he was getting bad information from his budget person.”

He wasn’t fired, the chancellor said, because “there was nothing that showed that funds were misappropriated or misspent. The funds were all spent on things we needed,” including additional fundraising personnel for an upcoming capital campaign

Choate will continue to collect his $350,000 salary and can stay on staff to assist Gearhart until June 30, unless he finds another job before then.


Many had mixed feelings, to put it lightly, about Choate continuing to collect this salary while he basically updates his resume and Linked in for several months on taxpayer dime. Meanwhile, Gearhart issued a lengthy statement.

Weeks later, Gearhart takes to the presses to complain about negative coverage of the scandal UA was receiving in the editorial section of the Arkansas Democrat-Gazette

"The editorials have been particularly mean-spirited and distorted the very facts that the newspaper itself reported," Gearhart says in the column.

Among Gearhart's greivances is the DG's assertion that the UA had been trying to keep the shortfall situation and fallout "very, very quiet."


However, the plot thickens. John Tyson steps down from the UA Board of Trustees without warning, despite a term lasting until 2017.

John Tyson of Springdale resigned from the University of Arkansas System Board of Trustees on Feb. 8, but the UA System didn't know about the resignation until Arkansas Business informed it of the move on Friday


Also, Gearhart ordered an audit of UA finances in February of this year

Facing $4M Deficit, Gearhart Requests Audits of University's Advancement Division

The university has not released the results of its own internal audit, saying the audit is part of personnel records. But Gearhart said those documents will be available for review by the independent auditors.

"The university has been transparent and accountable about this situation," Gearhart said in a news release. "I believe these audits will demonstrate that performance while still respecting the legal protections afforded public employees under Arkansas law."


Weeks later, Chris Wyrick was hired to replace Choate, who is still on payroll basically sitting in his office doing nothing at this point

Wyrick replaces Brad Choate, who held the position for four years. He was relieved of administrative duties after the deficit was discovered in June 2012. Choate is making $350,000 anually. Wyrick's salary will begin as soon as he officially starts his new job, UA spokesman John Diamond said.


Gearhart also commented

quote:

"I feel fairly confident that we’ve got our hands around it," Gearhart said. "Keep in mind that [the university] finished last fiscal year with a $30 million surplus, so, it’s important to point out that we can wipe the deficit out immediately. We’re in very good healthy fiscal shape. This is a deficit that was in one unit of the university."


Gearhart and UA refused to release the results of the audit. The Arkansas Democrat-Gazette filed this FOIA request in an attempt to review the audit. They were rebuffed by Gearhart and Diamond for two months. Diamond said the documents were not FOIA worthy because "employee evaluation or job performance records" are exempt. Gearhart offered another, different excuse for why the documents could not be released.

During this time, Gearhart sent emails with simply "FYI" and a forward of Brad Choate's personnel file to people of prominence close to the University. The same files that were supposedly confidential. Ultimately, they were released.

Now we are in April, when Arkansas Business did a glowing piece on Diamond, who wrote the speech Jeff Long read to fire Bobby Petrino. The University of Arkansas has received an award for “Best Crisis Management” in the PR Daily's 2013 Nonprofit PR Awards for the speech.

In August now, Diamond is suddenly fired via text message from Wyrick. Remember, Wyrick was working for athletics raising funds just 6 months ago, now he is firing UA's spokesman

David Gearhart, chancellor of the University of Arkansas, told reporters Monday that he "and many members of the senior team" had lost confidence in the university's chief spokesman, John Diamond, months before Diamond's immediate supervisor, Chris Wyrick, decided to fire him after a particularly rancorous meeting on Thursday.

Diamond acknowledged to Arkansas Business that Gearhart had been unhappy with his service as far back as January, when they disagreed over how to respond to media demands for information on a budgeting shortfall in the University Advancement division.

"There is no question in my mind that the disillusionment that Dave Gearhart had with me had to do with my attempt to follow the [Freedom of Information Act] law and dealing with the media in general," Diamond said.

According to Diamond's account, he had expressed concerns about Wyrick's handling of Freedom of Information Act requests. Diamond also described a "pattern of inappropriate statements" by Wyrick described as "offensive and threatening." Among them were a comment about Catholics -- including Diamond -- that "travel in packs" and the use of the term "Brother Honky" to refer to a white administrator who attended a Black Alumni Society event.

Wyrick acknowledged that he had made a joking reference to Catholics having a "fish fry on Friday," and he said that "Brother Honky" was a nickname he was given by former black athletes from the UA and that he had also used it to refer to others. But he said Diamond never questioned these comments until "almost what I would call a tirade" after he learned of his reassignment on Thursday. Wyrick said Diamond seemed to be trying "to raise my emotional level to where his already was."

Contrary to Diamond's description of Wyrick's threatening behavior, Wyrick said that the meeting became a "volatile, threatening situation," and that as he was leaving Wyrick's office, "Diamond took an aggressive step toward me."

Diamond has been a finalist for jobs outside Arkansas in recent months, and Gearhart said he and Wyrick had hoped to give him time to find another job before terminating his employment with the UA. Diamond's salary is $173,354.

Diamond had been hired by Choate, and Gearhart told reporters that he thought Diamond had been to overtly loyal to and defensive of Choate even as his mismanagement of the Advancement Division was becoming public knowledge.


Again, people were getting upset with UA's handling of these personnel issues.

Gearhart is on Wyrick's side in all this, saying:

He said Diamond had for months resisted new leadership. He turned suspicion on Diamond by saying he'd remained supportive of the fired Brad Choate, who hired Diamond. He said Diamond had remained defensive of Choate and continued a close relationship, in appropriate under the circumstances. Funny thing for Gearhart to say since it was he who hired Choate and kept him on long after discovery of financial problems. Gearhart said the relationship with Diamond had become 'irreparable.


Now we are to August, and Gearhart headed a conference call with the media to spin the events



Gearhart also made a Youtube video, as he likes to do, to tell students/friends/faculty that he did nothing wrong. This video has since been deleted.

September 13, Diamond spoke to the Arkansas legislature under oath. He told them that Gearhart encouraged the destruction of financial/audit documents during the time in which UA was obstructing the FOIA request months ago. Gearhart denied the allegations.

"I am shocked, and I find it pathetic that we have a person here who has been dismissed from the university making allegations," Gearhart said. "There is no proof of that. He cannot prove it."

Diamond's statements prompted the legislative panel to keep open its investigation of the university's Advancement Division, and a co-chairman of the panel said more hearings may be held to look into the claims.

"Given the magnitude of what Mr. Diamond was saying, I think it warrants at least keeping the door open to where we can get to the bottom of this," Rep. Kim Hammer, the audit panel's co-chairman told reporters after the hearing.

CLIFF NOTES

TL;DR

UA has major budget frickup, they give the guy a golden parachute. UA hires a new guy and they obstruct a request for audit documents. New guy fires UA spokesman John Diamond in August after heated arguments. Diamons claims that Chancellor Gearhart ordered the destruction of the audit documents months ago, that's why they weren't available for FOIA

I have spent the last 3 hours doing a ton of reading while helping a kid from church with homework. So before I spend my precious time reading answer me this.


Is this going to affect football season?

I agree

Also, I don't think someone we trusted to interface with the media daily would take the risk of lying under oath. I think he knows the consequences of that

A lot of people don't like Dave to begin with....the truth will come out sooner than later.

I know this...I've been waiting on something from the UofA legal department for a couple months and they drag their feet worse than anyone I've ever done business with.

I mean, they're not on top of anything at all. Slow, unprepared, and forgetful.

Legal departments hate him! Area man uses one weird trick to get legal documents returned to him in a timely manner.

The weird trick is the FOIA request. I'm not sure what is Hawgeye's issue, but I thought this would be a good jumping off point. The FOIA request is such a great thing. Legal departments/records custodians are usually required to answer all legitimate requests in a timely manner, usually a few days. You have to pay for copies to be made at a reasonable rate, sometimes as much as ten cents a page, which is bullshite, but whatever. (10 cents really ads up when you don't have a narrow request and they dump a few thousand pages on you.)

So when a FOIA request goes unanswered for a long time, it's usually a pretty good indicator that someone fricked up and fricked up bad. Best case scenario for an institution is that someone sat on the request and just didn't do their job. Worst case is that someone destroyed documents to subvert or obstruct the information from getting out.

That's a lot of red flags, and that will mean scrutiny. As far as - does this mean anything for the athletic department? - I don't know, but with increased scrutiny and lawmakers wanting to score political points, it could conceivably bring increased attention to the private/public Razorback Foundation and demands it open up its books and inner workings to the public. That would be extreme, but so is destroying documents, so who knows? And if things are run over there like they should be, even opening that up wouldn't matter either.
