Off duty officer shooting

In Calif, 13 year old boy arrested for defending a girl who was being cursed out. Several videos have surfaced that states the boy's claim of what happened.

I saw that on the news last night. The cop handled it badly but his case against the teens is solid. Two of them were arrested for assault. He didn't intend harm by firing his weapon so I don't think he'll face any charges. He definitely was being set upon by the teens.

I've only seen one video and haven't really read any backstory. Do off duty cops have authority to detain people against their will? If so, how does that relate to detention of a minor by use of force?

The video I saw was pretty disturbing without knowing any context. What I did read was the guy was pissed at the kids for walking through his yard, and the kid he detained spit at him.

I guess some states may be different, but for Alabama an officer is never not an officer. They've got the same authority whether on the clock or not. For that matter, they've got the authority to enforce state law anywhere in the state. For example, if a Huntsville PD officer is on vacation at Orange Beach and sees you fire one up, he's well within his authority to take you into custody.

The fact that the person was a minor doesn't matter a bit. The level of force used is either justified or it isn't.

Based on what I've seen thus far, I completely agree. Even if he had some justification in detaining them, but pretty much everything after that looks very inappropriate.

I hope he goes to jail for about 15 crimes right off the top of head....

- brandishing a weapon
- discharging a weapon near a dwelling
- reckless endangerment of a minor
- assault
- battery
- child abuse
- child neglect
- failure to properly secure a firearm in the presence of a minor
- trespassing
- kidnapping
- false arrest
- use of a firearm in a terrorist act
- many Civil Rights violations
- attempted murder
- unlawful discharge of a weapon

Both sides fricked up, him being a off duty cop makes it even worse and I do think he should/will get fired.

With that said as soon as the kids attacked him he had the right to shoot the attackers. I don't care their age, as soon as he was tackled then had punches thrown it crosses over into fear for life and self defense.

I don't know the whole story and quite frankly could care less so I'm not going to jump into if what he did before he was attacked was right or wrong.

Not about being a Statist, it's about wondering why the frick can't people just listen? I've been to dangerous countries before, armed and unarmed -- when other people have weapons, shut the frick up and try to avoid the situation whenever possible.

But no, not in America. You're not going to detain me. It's better if we swarm some random guy who says he's an undercover cop. That's what we're gonna do. You can't arrest me, no one can touch me.

America has, not only, a cop problem regarding escalation, but we have a problem of people having no idea how to respond to any kind of authority. Special snowflakes who've never been under the power of another person and don't think it can happen to them.

Because most of America has been taught growing up that they are special and no one can tell them how to live and younger generations are actually applying that to their life.

If most of America realized that they don't matter, their opinion doesn't matter, and if you want to be treated specially you better learn needed talents or amass enough money to hire people to kiss your arse, we'd as a country improve.

Also SCOTUS ruled it is not only lawful but a Citizens duty to resist unlawful arrest up to and including killing the shite bird cop.

Scalia wrote the majority opinion. Maybe you pigs should know the law you are trying to enforce...
