As the article says there's almost no chance it's successful. Implied assumption of the risk will eliminate liability. She knew that their practice was throwing rolls and she ate there anyway.

True story: During my senior field trip in high school, we went to Branson and stopped by Lambert's on the way back. I watched an older man shove an entire roll down his throat while we were waiting to pay, and started choking. The paramedics were called and he was on the ground for several minutes before they arrived. I saw them scoop a handful of bread out of his throat. I have no idea whether he lived or died, but it's quite possible he died after so long with a completely blocked throat.

If you get taken out by a soft piece of bread thrown at speeds no higher than 20 MPH, then you need to a Darwin Award waiting for you and have your funeral protested by Westboro whenever you go.

What bad publicity? This is actually good publicity. Everyone thinks the plaintiff is stupid, and Lambert's looks like an innocent victim of a frivolous lawsuit.

Now if she had gotten food poisoning or something then you'd want to settle.

Hey I totally agree with you on the publicity thing. However, I'm sure they consulted a lawyer and good luck finding a lawyer that would think this is good publicity.

This was actually written in the complaint "sustained a lacerated cornea with a vitreous detachment and all head, neck, eyes and vision were severely damaged"

The vision I kind of get, but what the frick does "all head and neck were severely damaged" mean? By a roll? Plaintiff has already lost a lot of credibility in the case with that sentence.

I like Lambert's (even the food), but just advertising that they throw rolls does not get them off the hook. If they hire Nolan Ryan who intentionally throws a roll at your face while you are not expecting it at 80+ MPH you'd happily sue the shiite out of them if it destroyed your vision in one eye.

That obviously didn't happen here, but it will come down to the actual facts of what happened. Simply advertising that they throw rolls does not allow them to negligently injure customers.

But it's really no different than attending an MLB game. There is an assumption of risk involved.

Thought, admittedly, if the rolls are so hard that they can cause damage... well, that doesn't sound like good food to me.
