Liberals are able to dismiss everything that would keep America as a sovereign nation and, in the case of the emails, things that compromise national security.

I think that it depends on how "possession" is defined. One can argue that simply clicking a link and reading is not possession, much like watching a TV show through cable or listening to a radio program; the companies are in possession and you are simply a viewer. The federal gov't, of course, would still likely nail your arse to the wall since the 5th Amendment has been circumvented and they can hold you indefinitely without charges if they really want to.
